What this limited warranty covers

Fortwell warrants to the original residential owner that any Fortwell-manufactured product will be free of material defects in manufacturing and materials for the applicable period stated in the tables below. This warranty applies to the products under normal use and service, subject to the conditions, exclusions and limitations described here, and only for so long as the original owner owns and resides in the home where the products are installed — except as set out under Transferability.

Fortwell's liability under this limited warranty is limited to the repair or, at Fortwell's option, the replacement of nonconforming goods or parts. Fortwell is not responsible for any labour or delivery cost incurred in repairing or replacing the products, nor for any incidental or consequential damages arising out of a claim under this warranty, including without limitation damage to ceilings, walls, floors, electronics or appliances within a residence. The original warranty period is not extended by a repair or replacement.

Replacement product may not match the colour of the original product or of the remaining windows and doors in the home; colour varies with age, weathering and dye lot. Fortwell reserves the right to discontinue or change the design and specification of any product it manufactures, and where an original component is no longer available Fortwell may substitute a part it determines to be of equal quality and performance.

Residential — owner-occupied

Coverage for Fortwell products installed in owner-occupied residential homes. Every period below begins on the date Fortwell delivers the product to the customer's specified location.

Commercial, investment and non-owner-occupied dwellings

Fortwell products installed in non-owner-occupied dwellings such as apartments and rental homes, or used for commercial purposes such as schools, hospitals, government structures and office buildings, are covered only as set out below and remain subject to every exclusion in this warranty.

Installed outside the continental United States

For exported product, Fortwell's liability is limited to replacement of nonconforming goods or parts or, at Fortwell's option, refund of the amount paid to Fortwell. Fortwell is not responsible for on-site inspections, warranty labour or delivery costs.

Coverage in detail

Frame

Aluminum extrusions and frame components are warranted to be free of defects in material and workmanship for the period stated in the tables above.

Anodized product will show some colour variation and processing marks arising from manufacture. These are inherent to the finish and are not defects. This warranty is null and void where an aluminum component is in direct contact with copper-treated timber such as Alkaline Copper Quaternary (ACQ).

Frame finish

Class I anodized and AAMA 2604 powder coat finishes are warranted against peeling, blistering, chipping and excessive colour change under normal use.

Coverage is void where the finish is damaged by harmful cleaners, chemical exposure, abrasive maintenance, or any other exclusion set out in this warranty.

Hardware, screens and moving parts

Fortwell warrants that the mechanical operation of hardware, screens and moving components will be free of defects in material and workmanship for the applicable period.

Excluded are normal wear and tear and naturally occurring changes such as tarnish, corrosion, oxidation or discolouration of hardware finishes and component parts.

Glass

Glass carries inherent characteristics — distortion, bubbles, discolouration, blurs, debris and light scratching — which are expected and excluded from this warranty where they meet or exceed the standard specifications for flat glass (ASTM C1036), heat-treated flat glass (ASTM C1048) and laminated architectural flat glass (ASTM C1172).

Heat-strengthened and tempered glass may show distortion as an inherent quality of the process. Coated glass may require specific cleaning; failure to follow the recommended care and maintenance voids this warranty.

Laminated glass unit

Laminated impact glazing is warranted to be free of defects resulting in material obstruction of vision or in delamination, for the period stated in the tables above.

Insulating glass unit

The sealed insulating unit is warranted to be free of defects resulting in material obstruction of vision, or in film formation caused by dust or moisture within the sealed air space, for the period stated in the tables above.

Stress cracks

Stress cracks falling outside Fortwell's glass policy guidelines, or arising from natural building settlement or extreme thermal differentials between inside and outside temperatures, are not defects in material or workmanship.

Transferability

Where the tables above show the warranty as transferable, it passes to a subsequent owner provided Fortwell receives notice of the transfer of title within thirty (30) days of the ownership change, accompanied by a copy of this warranty and the original order number. There is no fee for the transfer.

If the warranty has not already expired or been voided, it is extended to the subsequent owner for ten (10) years from the date Fortwell delivered the product, subject to every condition, exclusion and limitation set out here.

Residential intruder protection

For 100 and 150 Series impact-rated products, Fortwell will reimburse the original residential owner for property loss arising from a burglary through a locked pane of impact-resistant glazing that has been smashed or broken by an intruder, up to the owner's insurance deductible and not exceeding one thousand dollars ($1,000), for ten (10) years from the date of delivery.

A claim must be filed within thirty (30) days of the burglary with proof of purchase, a copy of the police report, a copy of the loss notice submitted to the owner's insurer, and two photographs of the broken unit showing the glass manufacturer's logo.

What this warranty does not cover

This limited warranty covers only the manufacturing and material defects specified above. It does not apply to defects or damage attributable to or caused by:

  • Improper installation, storage, application or use.
  • Failure to follow Fortwell's recommended cleaning, care and maintenance instructions.
  • Normal weathering, and corrosive or otherwise abnormal environments.
  • Condensation, except as described under Insulating glass unit.
  • Accident, fire, flood, acts of God and multiple hurricanes.
  • Water intrusion, including intrusion caused by wind-driven rain during high wind events.
  • Vandalism, riot or civil disorder.
  • Building settlement, excessive building movement, or structural failure of walls or foundations.
  • Localised heat producing excessive temperature differentials across glass surfaces and edges.
  • Aluminum components in direct contact with copper-treated timber such as ACQ.
  • Naturally occurring change such as tarnish, corrosion, oxidation or discolouration of finishes and component parts.
  • Any occurrence beyond Fortwell's control.

This warranty is null and void if harmful solvents are used to clean the product; if any portion of the product is painted or coated in any way after it leaves the Fortwell factory; or if aftermarket products such as window films are applied to it.

Caulking is used on some installations to seal frames against water or air penetration. Caulking is not part of the Fortwell product, is not covered by this warranty, and remains a maintenance responsibility of the owner.

Owner responsibility

The life of a window or door increases with proper care. Every Fortwell product requires reasonable care and periodic cleaning, and installations in salt-air environments require more frequent maintenance — fresh-water rinsing of frames, tracks and hardware, and inspection of drainage paths.

Failure to follow the recommended cleaning, care and maintenance requirements will void this limited warranty.

How to file a claim

Any claim under this limited warranty must be submitted promptly after discovery, and within the applicable warranty period, to the dealer or distributor from whom the product was purchased. If that dealer or distributor cannot be located, contact Fortwell directly at info@fortwellwindows.com or through the contact page.

Every claim must include proof of purchase, the product identification or order number, the address at which the product is installed, and a description of the problem. Photographs of the condition materially speed up assessment.

Legal notices

Some states do not allow the exclusion or limitation of incidental or consequential damages, or the limitation of remedies for a breach of warranty, so the limitations and exclusions above may not apply to you. This warranty gives you specific legal rights, and you may also have other rights that vary from state to state.

No distributor, dealer or representative of Fortwell has the authority to change or modify this warranty in any respect, either orally or in writing. Except as expressly provided in this warranty, Fortwell makes no warranty, express or implied, including no warranty of merchantability, no warranty of fitness for a particular purpose and no warranty of noninfringement, and Fortwell disclaims all warranties not expressly provided here.
